Can I Modify My 72(t) SEPP Plan After It Starts?
One of the most important — and most misunderstood — aspects of 72(t) SEPP planning is the modification rule. Once your plan begins, the rules for what you can and cannot change are strict. Here's what you need to know.
The Basic Modification Rule
Under IRS rules, any modification to a 72(t) SEPP plan before the required period ends (5 years or age 59½, whichever is longer) triggers the 10% early withdrawal penalty retroactively on all prior distributions, plus interest. This is one of the most severe penalties in the tax code — and it applies even if the modification was unintentional.
What Counts as a Modification?
The IRS defines a modification broadly. Prohibited modifications include: changing the distribution amount (except for the one-time switch from Fixed Amortization to RMD), stopping distributions before the required period ends, rolling over the SEPP account to another IRA, making additional contributions to the SEPP account, and taking any additional distributions beyond the calculated SEPP amount.
The One Permitted Change
The IRS allows one modification: a one-time switch from the Fixed Amortization or Fixed Annuitization method to the RMD method. This switch is typically used when a significant account balance decline makes the original distribution amount unsustainable. This is the only change permitted without triggering retroactive penalties.
What Happens at the End of the Plan?
Once the required period ends (5 years or age 59½, whichever is longer), you're free to modify your distributions in any way. You can increase, decrease, or stop distributions entirely. At this point, normal early withdrawal rules apply — if you're under 59½, distributions beyond the SEPP amount are subject to the 10% penalty.
